This User Agreement is a contract (hereinafter the "Agreement") between the 3FAB Dating App Service and its User and may be accepted only by accepting the Agreement and the Privacy Policy in general.
Terminology
User profile — is information about a User including photo, nickname, gender, age, preferences, email address, education, and profession. All of this information is available on the «3FAB Dating App» platform. «3FAB Dating App» Administration is not responsible for the accuracy and completeness of this information.
Coins — Coins are an internal unit of account intended for the purchase of additional Features on «3FAB Dating App». Coins are not a payment or cash equivalent and are not refundable, transferable to e-wallets or exchangeable for cash. Coins are not time-bound and may be used by a User only to purchase additional «3FAB Dating App» Features that are eligible for Coins. The terms and conditions for the purchase of Coins are specified on the «3FAB Dating App» platform.
User — is an individual over the age of eighteen years, accessing «3FAB Dating App» via the Internet through the «3FAB Dating App» Mobile App and/or website, accepting and agreeing to the terms and conditions of this Agreement.
«3FAB Dating App» mobile app — is an App designed to run on smartphones, tablets and other mobile devices based on Android 5.0 and above, iOS 12.3 and above, which is available for download on the store platforms. It is also intended for installation of the App and sign-up by the User, and allows you to use the functionality of the Service in the selected range on the User's mobile devices.
Sign Up — you fill out the registration form provided on «3FAB Dating App» by entering the required information in the application form.
«3FAB Dating App» Service or Service — a set of hardware and software owned by the 3FAB Dating App, through which we provide you with access to the Features and Services available through the Mobile App and/or the 3FAB Dating App's website.
Features — information services that provide information exchange between you, posted on «3FAB Dating App».
Account — a set of data about you that is necessary to identify (authenticate) and provide access to personal data and settings. Your account may optionally contain personal contact information.
Functionality — features of the service, presented through the mobile app and/or the company's website.
Filters — information about your preferences regarding other Users,
1. Subject of the Agreement
1.1. We provide you with the services enabling you to use «3FAB Dating App» on the terms and conditions of this Agreement.
1.2. We give you access to «3FAB Dating App» for communication with other Users for the purpose of exchanging information between you, as well as providing other Services and Features available on «3FAB Dating App».
1.3. Unconditional acceptance of the terms and conditions of the Agreement shall be deemed to be your signing up on «3FAB Dating App». Before using the platform, you must read this Agreement. If you disagree with any particular term or the entire Agreement, you should discontinue all further usage of «3FAB Dating App». You fully and unconditionally accept to the terms of this Agreement by committing one of the following acts - copying (installing) the Mobile App by yourself to your mobile device; - using «3FAB Dating App» in any way and/or your signing up; - clicking the "Continue" button when you Sign up using your cell phone number, on the platform or through the Mobile App. By using the Service, you also acknowledge your acceptance of the Privacy Policy posted at https://3date.app/Privacy/. Use of the Service and its Features is allowed only under the terms of this Agreement.
1.4. Service is aimed to familiarize the User with the rules of use of the Service. The User has access to information about the options for using the Service, the Features, the Fees and payment terms, the rules of behavior and other information necessary for the use of the Service. Based on the information provided, you decide for yourself whether to use «3FAB Dating App», post information about yourself and your preferences, and post your photos. Your signing up on «3FAB Dating App» confirms that you've read the terms and conditions of «3FAB Dating App», the User Agreement and Privacy Policy.
1.5. This Agreement may be amended by us unilaterally without any special notice to the User. The new version of the Agreement comes into effect from the moment of its posting on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Agreement. The current version of the Agreement is available on the official website 3date.app in the section Information > User Agreement. If you disagree with any provision of this Agreement, or amendments to it, you must stop using «3FAB Dating App».
1.6. By accepting the terms of this Agreement, you express your acceptance of the terms of this Agreement and the Privacy Policy. By accepting the terms of this Agreement, you confirm that you have reached the age of 18, confirm the accuracy of the data you provide under this Agreement and take full responsibility for its accuracy, completeness and truthfulness.
2. Sign-up Process
2.1. When using our service, you create an account through our mobile app and/or website. You can only have one account, otherwise we reserve the right to block or delete your repeated accounts.
2.2. When creating an account, you create and enter a password, and you commit to keeping the password safe and secure from third parties.
2.3. If you lose or compromise your password, or if a third party illegally obtains your password, you should immediately contact the Support Service at support@tsdatingup.com.
2.4. When signing up, you will be asked to fill out a registration form that includes the required fields:
name;
gender;
phone number or sign up using social networks;
photo or Video;
place of residence.
2.5. You agree to provide true and complete information about yourself and to keep this information up to date. Your image in the photo and/or video should allow you to be recognized when encountering other users. If you provide inaccurate information or if we have any doubt that the information you provide is incomplete or untrue, or the picture does not belong to you at all, we reserve the right to block or delete your account and deny you use of the Service (or any of its features).
2.6. You are given the opportunity to sign up through social networking plugins provided by our service.
2.7. If you've changed your sign-up information, you need to contact «3FAB Dating App» Support immediately to notify them of the change in your information.
2.8. If you have provided incorrect or incomplete information, we are not responsible for providing services for mistakenly specified data, as well as for providing profiles of other users who do not match your filters.
2.9. Our service is not available to individuals under 18 years of age. By signing up, you confirm and warrant that
you are over 18 years of age and fully accept the terms of the agreement;
you consent to the transfer of your personal data to other users, specifically: Full name, nickname, gender, age, location;
you consent to the posting of information about your preferences indicated by you on the Service;
you give your consent to your location and its indication for viewing by other users by the Compass Feature;
you understand and accept the fact that by using the «3FAB Dating App» service, your location may be seen by other users. We are not responsible for any disclosure of your location to third parties. If you have concerns or worries about using your data we strongly advise you not to sign in to the «3FAB Dating App» platform.
2.10. If during verification by selfie or photos we have suspicions that you are under 18 years of age, or if we receive complaints from other users about possible use of the service by an underage person, we reserve the right to ask you to confirm your age and identity by taking selfies with a passport (it is important that your face and your ID document must be clearly visible in the picture).
3. Terms of Use of the Service
3.1. We provide you with «3FAB Dating App» for personal, non-commercial use.
3.2. Under the terms of «3FAB Dating App» you choose other Users to communicate or to arrange Events or personal meetings yourself.
3.3. You are given the access to other Users' profiles to choose a match and express your sympathy to them.
3.4. When using «3FAB Dating App», you understand and agree that: - the quality of the selection of another User as a partner depends on the Filters you use, including when arranging Events; - We do not guarantee the likes of other selected Users; - We do not guarantee the interest of other selected Users in meeting with you; - To fulfill Our obligations under this Agreement, We share the data you have provided exclusively at Sign Up with other Users selected as partners.
3.6. While we make every effort to provide quality Services on «3FAB Dating App», we cannot guarantee and are not responsible for the accuracy and completeness of the information you provide. We are not responsible for the reciprocal likes of other Users, their appearance in meetings, nor for the accuracy of the Profile of the selected User.
3.7. Our communication with you is performed via email and/or a «3FAB Dating App» account and/or push notifications. Your communication with us has performed via email support@3date.app or a feedback form within the App or on the website 3date.app.
4. Photo requirements on the Service
4.1. When you sign up on «3FAB Dating App», your picture or your video is required.
4.2. All your photos and videos are subject to compulsory moderation by the company's specialists.
4.3. We do not allow you to post photos or videos of the following:
too explicit or pornographic or with erotic overtones;
with text and personal data;
that have no aesthetic value;
showing cruelty and violence;
promoting smoking and alcohol use;
pictures of children without adults;
belonging to another person;
publishing photos that do not show your face;
where there are other people other than you, the captions;
violating others' rights, including rights of publicity, privacy, copyright, trademarks or other intellectual property rights.
5. Financial terms
5.1. We may provide you with free-based services, information about which can be found on «3FAB Dating App» and in the fee-based services of the Platform.
5.2. We set the fee for the Paid Services, which are presented on the «3FAB Dating App» Platform. The cost of paid services is subject to change at Our discretion. Information about the current cost is indicated on «3FAB Dating App». The new cost shall be effective from the moment of its publication on the platform and shall not apply to the Services paid by you at the time of publication of the new Fees.
5.3. Payments for paid services are made through the payment systems or credit organizations listed on «3FAB Dating App». When paying for Services via payment systems or credit organizations, you undertake to read the terms and conditions of money transactions. It is your responsibility to follow the rules/instructions of the payment systems or credit organizations, and you are entirely responsible for the actions you take via your personal accounts or apps.
5.4. We have the right to obligate you to deposit money on your balance on the platform for further automatic deduction of funds according to the paid services hosted on «3FAB Dating App». If there are not enough funds on your balance in accordance with the selected paid service, you agree to replenish the balance within 2 (two) calendar days from the date of receipt of a notice from us.
5.5. When you pay by debit card, payment processing (including entering the card number) takes place on a secure page of the processing system. Card data is transmitted only in encrypted form and is not stored on the server of the Company. All operations with payment cards are performed in accordance with the requirements of payment systems. When transmitting information, special security technologies of online card payments are used, data processing is carried out on a secure high-tech server of the processing company.
5.6. All fees of payment systems and/or credit organizations related to the payment and transfer of funds shall be paid by you at your own expense. The moment of payment is considered the moment of a positive result of authorization of payment in payment systems and/or credit organizations, or the moment of receipt of funds on the account of «3FAB Dating App».
5.7. We are not a paying agent.
5.8. We would like to emphasize that we do not act as a tax agent towards Users. All obligations to comply with applicable laws on taxes and fees in relation to the received funds are performed by Platform Users on their own. We are not responsible for the User's failure to pay taxes or declare income.
6. Company Rights
6.1. We have the right:
to change the design of «3FAB Dating App» and/or its functionality, content, features, modifications or additions to the software used, or stored software and other objects, any server applications at any time without notice to the User;
to send you e-mail messages regarding the use of «3FAB Dating App», as well as advertising messages;
change the terms of the platform or terminate it (temporarily or completely) with or without notice to the User;
change or delete any content that violates this Agreement and/or United States laws, and suspend, restrict or terminate User access to all or any part of the Service, including the features with prior notice to the User;
to impose additional restrictions on the use of «3FAB Dating App», as well as to change such restrictions at any time;
to refuse to verify you if there are insufficient data and/or your photo does not meet «3FAB Dating App» requirements;
to terminate the access of any User to the Service without notice if, in our opinion, such User violates the rights of third parties;
to terminate the User's access to the platform and block his account in case of complaints from other Platform Users about his behavior and actions, either on the platform, or during personal meetings, at Events;
to provide paid Services to the User;
at any time unilaterally, fully or partially withdraw from the Agreement, notifying the User about it;
to engage third-party external services only to fulfill obligations under this Agreement. You agree that we may transfer User data (including personal information) to third party services under our Privacy Policy;
to block (delete) your account if you violate «3FAB Dating App»'s terms of use.
6.2. If we receive any claims for compensation for damages caused by your actions, we will forward such claims to the User. It is your responsibility to participate in our review of all complaints, claims, and demands related to the User's use of «3FAB Dating App».
7. Prohibitions when using the Service
7.1. You are not allowed to:
7.1.1. sign in on behalf of or instead of another person ("fake account");
7.1.2. mislead other Users about your identity, using the Login and Password of another registered User;
7.1.3. misrepresent your identity and your relations with other persons or organizations;
7.1.4. place photos of third parties, not your own, as well as photos in which the image of the User does not correspond to reality to the extent of non-recognizability;
7.1.5. perform actions aimed at disrupting the normal functioning of the platform or personal pages of Users;
7.1.6. in any way (including, but not limited to: by fraud, misuse of trust or hacking) trying to gain access to the username and password of another User;
7.1.7. post any other information that, in the personal opinion of the Company, is inappropriate, inconsistent with the objectives of the platform, infringes on the interests of the User, or for other reasons is undesirable for posting on «3FAB Dating App»;
7.1.8. send via e-mail, transmit or make available in any other way unauthorized advertisements and promotional materials, junk mail and SPAM;
7.1.9. use the Services to transmit, create and add mass unsolicited emails or other types of unsolicited email messages (SPAM). Non-compliance to the SPAM warning may also result in immediate termination of the User's account;
7.1.10. take any actions intended to disrupt «3FAB Dating App»'s proper functioning, or to attempt to bypass «3FAB Dating App»'s technical limitations;
7.1.11. copy, modify, change, delete, add, publish, transfer the exclusive and personal rights contained in «3FAB Dating App», create derivative works, make or sell products based on them, reproduce, display or otherwise exploit or use such rights without direct permission of their owners, place personal data of third parties on «3FAB Dating App», change the software part of «3FAB Dating App» in any way, perform actions aimed at changing the functioning of «3FAB Dating App»;
7.1.12. insult and otherwise violate the rights and freedoms of other «3FAB Dating App» Users, third parties, and groups of people, use offensive language, carry out or distribute information that calls for riots, extremist activities, participation in mass (public) events held in violation of the established order, distribute information necessary to obtain the results of intellectual activity and otherwise violate the rules of «3FAB Dating App»;
7.1.13. post content that: - might lead to civil, criminal or administrative liability; - Promotes or condones racism, fascism, hatred or violence based on factors such as race, ethnicity, religion, disability, gender, age, national origin, sexual orientation or gender identity, or other prohibited content; - contains pornographic or erotic content, advertising, promotion, recommendations of commercial sexual and intimate services, fraud or other illegal activities; - contains private information about Users, violating their personal rights, copyright or intellectual property;
7.1.14. use third-party apps to gain privileges, automate actions or cheat on «3FAB Dating App».
8. Responsibility
8.1. In case of non-performance or improper performance of their obligations, the parties shall be liable in accordance with the applicable laws of the United States Federation.
8.2. You use «3FAB Dating App» at your own risk. We provide it «as it is». This means that we are not responsible for any problems that arise during installation, updating, support and usage (including compatibility problems with other software products (packages, drivers etc.), inconsistency of «3FAB Dating App» usage experience with User's expectations etc.). The User shall understand that they are solely responsible for any negative consequences caused by incompatibility or conflicts between «3FAB Dating App» and other software products installed on the User's computer or other device.
8.3. Any materials and/or information (including downloadable software, any instructions and manuals, etc.), accessed by the User using «3FAB Dating App», may be used at the User's own risk and the User is solely responsible for possible consequences of the use of such information and/or materials, including any damage it may cause to the User's computer (device) or third parties, for loss of data or any other harm.
8.4. The 3FAB Dating App shall not be responsible and shall not be liable for any losses or other consequences of the User resulting from: - unlawful acts of third parties, other Users, including personal meetings; - refusal of one User to meet with another User; - violation by any person of any intellectual property rights of third parties associated with the use of «3FAB Dating App».
8.5. Software and hardware failures, whether on Our side or on your side, that result in your inability to access «3FAB Dating App» are circumstances of insuperable force majeure and grounds for the release from liability for the failure of «3FAB Dating App» to perform its obligations under the Agreement.
8.6. «3FAB Dating App» service interruptions are acceptable. If the platform fails to operate, we will not be liable for any failure to perform or improper performance of our obligations. We have the right to suspend 《3FAB Dating App» until threats or errors are resolved.
8.7. The Parties are relieved from responsibility for full or partial non-fulfillment of their obligations, if such non-fulfillment is a consequence of force majeure circumstances arising after the entry into force of this Offer, as a result of extraordinary events, which the Parties could not foresee and prevent by reasonable efforts. The Party, referring to circumstances of undeterminable force (force majeure), is obliged to provide for their confirmation a document of the relevant state authority.
9. Intellectual Property and Restrictions when using the Service
9.1. «3FAB Dating App» contains intellectual property owned by the platform, its affiliates and other related parties, sponsors, partners, representatives and other third parties.
9.2. Trademarks and trade names, software and other data published and available on «3FAB Dating App» are the intellectual property of their respective owners and protected by the laws.
9.3. By using «3FAB Dating App», you acknowledge and agree that all «3FAB Dating App» content and its structure are protected by copyright and other intellectual property rights and that these rights are valid and protected in all forms, in all media, and in all technologies, whether now existing or later developed or created. Any rights to any «3FAB Dating App» content, including but not limited to audiovisual works, text, graphics, computer programs, photos, trademarks do not pass to the User as a result of using «3FAB Dating App» and entering into the Agreement.
9.4. All of your intellectual property rights posted on «3FAB Dating App» are granted by you under a simple non-exclusive license for the entire term of copyright protection without payment of any royalties to you from the moment of posting.
10. Messaging service (chat)
10.1. You are given the access to «3FAB Dating App» to exchange messages (hereinafter referred to as "chat"). Your personal data is processed in accordance with the legislation of the United States Federation. Our administration has the right to use the information you provide in order to comply with the requirements of current legislation of the United States (including the prevention and/or suppression of illegal and/or unlawful actions of users).
10.2. You agree to receive personal messages through the chat from the administration at any time and of any nature, including advertising. We have the right to moderate (preview, evaluate and filter) messages sent to users in chat.
10.3. You are not allowed to use the Chat to:
posting messages containing advertising information and/or spam;
uploading, posting, transmitting or in any other way publishing material that is unlawful, harmful, threatening, offensive to morality, defamatory, in violation of copyright, advocating hatred and/or discrimination against people on racial, ethnic, gender, social grounds;
sending out links to websites belonging to you and/or other users;
sending messages containing swear words, insults to third parties, including the information specified in clause 7.1.13 of this Agreement;
10.4. We reserve the right to delete, move or edit posts in full or in part if they violate the terms of this agreement or are otherwise unacceptable.
10.5. We reserve the right to disclose your personal information to third parties if we receive a complaint that material you downloaded from the app or site violates their copyright, privacy rights, or as required by law:
to comply with legal orders, such as a court order, subpoena or search warrant, government/law enforcement investigation, or other legal requirements;
to assist in preventing or detecting crime (in each case according to applicable law);
to protect the safety of the user;
if the disclosure would reduce the company's liability in an actual or purported lawsuit;
to protect, when necessary, the legal rights of the company and the legal rights of service users, business partners, or other interested parties;
to ensure that agreements are followed;
to investigate, prevent, or take other action with respect to illegal activities, suspected fraud, or other violations.
11. Personal information
11.1. By accepting this Agreement, you agree to our processing of the personal information you provide during your sign up, as well as the personal information you voluntarily submit to «3FAB Dating App», and its transfer to third parties for the purpose of providing the Services.
11.2. Processing of personal data includes actions (operations) with personal data, such as collection, systematization, accumulation, storage, clarification (updating, modification), utilization, distribution (including transfer), depersonalization, blocking, deletion of personal data.
11.3. By signing up, you agree to read the Privacy Policy posted on «3FAB Dating App».
11.4. Your consent to the processing of personal data is granted without time limitation.
12. Other conditions
12.1. You warrant that all of the terms of this Agreement are clear to you and that you accept them unconditionally and in full.
12.2. If you have any questions or complaints, we recommend sending an email to support@3date.app.
12.3. All disputes arising between the parties will be resolved by negotiation, if no agreement is reached, the dispute shall be considered in court at the location of «3FAB Dating App».
12.4. In everything else that is not provided for in this Agreement, the Parties shall be guided by the applicable laws of the United States.
12.5. The invalidity of any provision of this Agreement shall not invalidate the remaining provisions.
